When natural persons sell services or products to us, Desch IPP Spółka z o.o. follows provisions of Art. 13.1 of Regulation (EU) of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter “GDPR”, namely:
• Desch PP Spółka z o.o. with a registered seat at 41-923 Bytom, 16 Elektrownia St., is the Data Controller,
• Processing your personal data, such as your name and surname (business name), address, tax ID No, and other data, you may freely provide, is necessary for the performance of a contract based on Art. 6.1b) GDPR: processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract; thus, data is processed in order to conclude and perform a contract for purchase / sale of products and / or services, or send any correspondence to you;
• Your personal data is also processed under Art. 6.1c) GDPR: processing is necessary for compliance with a legal obligation to which the controller is subject, i.e. storing documentation for a period of time stipulated by relevant regulations when processing is aimed at retaining documents for a period of time set forth in the law;
• Your personal data is also processed under Art. 6.1f) GDPR: processing is necessary for the purposes of the legitimate interests pursued by the controller, such exercise or defense of legal claims;
• Your personal data will be disclosed to the following groups of interested parties: authorized and trained personnel processing such data, entities processing data based on written contracts, and postal operators delivering mail.
• Your data will also be stored once the contract has been performed, with the retention period being one year longer than the one stipulated by laws on mandatory retention period for financial documents.
• You have the right to request access to your personal data, to have your data corrected or erased, and to restrict processing of your data. You also have the right to lodge a complaint with the President of the Personal Data Protection Office;
• Provision of your personal data is voluntary but necessary for the performance of a contract; failure to supply such data will prevent us from entering into a contract;
Furthermore, Art. 21.1 GDPR stipulates you have the right object, on grounds relating to your particular situation and at any time, to the processing of your personal data under Art. 6.1f) GDPR.
